Is Your Pool Safe?

A blogger from Brazil dropped by my blog for a visit recently. Her name is Odele Souza. This was her comment:

"Hello, I am Brazilian. I arrive here because I read your comment in David Santos' blog. My blog, Flavia, Vivendo em Coma (Flavia, living in Eats) is dedicated to my daughter Flavia, who is in coma for more than nine years. The blog is written in Portuguese but you can read it in English or another language, just clicking on the right flag. The translation is not so good but helps. Thanks for your attention. ... "


I visited her blog and used the computer translation (note to self: learn more languages!). My heart went to bits reading about her daughter's condition. I still could not understand what caused Flavia to be in a coma until yesterday when Odele posted a story about a young girl, named Abigail Taylor, who nearly died in an awful pool accident.

I wanted to share Flavia's story but I did not want to give out any wrong information based on the computer translation. I had to ask Odele for her help. Here's what she said:

"The translation services on the blog is not any great prize, and because of this you didn't understant the whole story about Flavia. When I mention the accident with Abigail is because of the same reason. I meam, both Flavia and Abigail had been victims of a filtration system of a pool, - with problem.

On January 06, 1998 Flavia was swimming in the pool of the building were we lived, whem the filtration system of the pool got Flavia's hair under water, and this happened because of the strong suction of the drain, that lately was proved had problem. Abigail like Flavia, were victim of negligence. If the filtration system is in order nothing happens with people while swmming, but if on the contrary, the filtration system is not in order, it can be very dangerous to be in the pool.

It is important to protest against this kind of negligence and clain for justice. That is what I am trying to do with Flavia'a blog: Clain for justice, because till now, ten years after the accident that left Flavia in Coma, the responsible for the negligence with the drain didn't pay for nothing. It is also important to alert people for this kind of danger in the pools.

In spite of my English is not any great prize too, I hope you can understand now a litlle more about Flavia and Abigail accident...."

"Abigail Taylor is what doctors call a medical miracle. The six-year-old is sitting up, talking and fully aware that she nearly died last Friday in a horrific pool accident at the Minneapolis Golf Club's Kiddie Pool. Abigail sat on the drain at the bottom of the pool and doctors say her bottom created suction on the drain. They say the strength of the suction from the drain pulled part of her small intestines out of her rear end. Her mom says Abbey somehow pulled herself off the drain and out of the pool before collapsing into the deep end of the regular pool."

"In some pools, the suction is strong enough to pull your insides out.

That's the disturbing reality for a six-year-old in Minnesota girl. There's a push for tougher pools safety laws to stop it from happening in Maryland. Mike Hellgren reports little Abigail Taylor has bright brown eyes and a big smile, but she will never be the same again after a pool drain in a swimming pool sucked out her intestines and ended up in the filter.

"She more or less blacked out, she passed out, fell face-first onto the pool decking," said her father Scott Taylor.The suction ripped a hole in her rectum. She'll have to be fed through a tube and will have to wear a colostomy bag for the rest of her life."It never even crosses anybody's mind that potential at the bottom of that pool is enough force to literally disembowel a child, an adult," said Scott Taylor"

Hi Jacqui,

When I first read the news a few days back, I was shocked...We've always thought of pools as safe (besides the 'water' part) and then we hear of how people, especially children, literally get disemboweled...

Scary isn't it?

And now dear little Abigail will have to be fed through a tube and have a colostomy bag for the rest of her life...

Poor little thing; I hope she gets better and the pool-company and those responsible pay for it...

PS: Where have you been anyway? Long time since I saw you online! =)

Yeah, I too thought that pools were safe. It is scary.

Flavia, Odele's daughter, remains in a coma and the people responsible .. have not paid for their negligence.

Poor Abigail too. *sigh*

Thank you very much for this well done post regarding the accidents with Abigail,(USA) in the beginning of July and with my daughter Flavia,(BRASIL) almost ten years ago. Abigail and Flavia never more will be the same and people have to know that this kind of accident can happens again, anywhere in the world. It is urgent a pool safety legislation in order to protect people, mainly children. People responsible for negligences that cause tragedies like these ones, shoul be punished withou delay. Here in Brasil, Flavia, in coma, is waiting for this punishment for almost ten years.

Simply do not understand yhy isnt the relevant authorities passing the bills and just sweeping these problems under the rags!?

The safety pool regulation or company that produces these filters, they need to do more tests before putting those products out! Dont ruin the lives of innocent young victims.

Pray that Flavin will get out of her coma soon.

I don't understand either. Even if the products are tested and approved, then placed in the pool system, how can they ignore something as simple as pool maintenance?

I pray too that Flavia comes out of her coma soon.

Flavia and Abigail are only two examples of this kind of accident that unfortunately happens more than people think.

Virgínia Baker, a seven years old girl died for years ago in an accident with the drain of a pool.
It happened in USA. Her grandmother, Nancy Baker spoke some days ago in CNN TV. I got this from http://usa.safekids.org

Baker’s granddaughter, Virginia Graeme Baker, died four years ago when she became entrapped in the drain of a spa. It took several adults to help pry her free from the force of the drain, but it was to no avail. She had drowned. This tragedy occurred at a graduation party that was well supervised by scores of adults."

People need to realize that it is important to denunciate in order to stop with negligences and prevent more tragedies.

Sorry to hear that Flavia is in a coma because of the pool accident. I hope and pray that she does come out of her coma.

Was a case filed against the pool owner for negligence in maintaining the pool? What is the status? How could such a thing have happened in Brazil?

Governments are duty bound to ensure all pools are registered and regularly maintained. In spite of the best laws, accidents do happen but victims have to be protected.

I think there was an incident in an "unlicensed" theme park in KL recently where one of the park's staff died while trying to retrieve something from the pool but got sucked in instead. But the hoo hahs that came out of the incident were more on the fact that the park was operating without license bla bla bla... I don't think people actually learned about the safety precautions that should be taken.

heard of these things happening for many many years. it's sad that not much have been done to protect swimmers, especially the little ones.

I thought pools were safe as well - as long as they had a fence around them! Scary to hear about these super strong filtration systems! Thanks for bringing our attention to it!

I heard that the drain is usually in the deepest part of the pool. But for kiddie pools the deepest is not deep. Kids can still stand or sit near the drain.
I'm too wondering why authorities concerned have not seen this as a hazard.

There are two responsible for the accident with Flavia:

1. JACUZZI DO BRASIL – Is the manufacturer of the filtration system installed in the swimming pool where Flavia was swimming. JACUZZI sold the filtration system, without any warning, about how danger it could be, if installed not in accordance with some measures, for example: That filtration system should not be installed in that pool, because it was too big and too strong for the size of the pool, a small one.

2. CONDOMINIUM JARDIM, DA JURITI. The building (with 32 apartments ) where we lived at the time of the accident. – Bought and installed, without any technical assistance, the filtration system too big and strong for that pool.

What is the status?

I processed both Jacuzzi and the Condominium. But till now, almost nine years (nine years!!) waiting for an adequate sentence, neither Condominium nor Jacuzzi were CONDEMNED by Brazilian justice to pay any indemnity or reparation to Flavia. In the next two months Flavia’s process is following to Brasilia, the capital of our country, where, in our last chance, we will try that the Brazilian judge, CONDEMN Condominium and Jacuzzi to pay for their negligence.

We have a good lawyer, but it was not enough to have JACUZZI and the condominion CONDEMNED, because, at least here in Brazil, it depends on the judges that analyze the process and in spite of all proves attached to Flavia’s process , till now, the Brazilian judges didn’t CONDEMNED the guilty parties and till now Flavia’s human rights has been not respected.

Thank you Jacqui for let me use your blog to inform people about this kind of accident. Information is important.

public swimming pools normally have their filtration system switched on when the pool closes. Some pools in KL only filter their water once a week. so, in terms of what happened to little Flavia, that can be avoided. it's just that, the pool would look very dirty la.

Sometime last year I took my two boys (then 12 & 5) to the "unlicensed" theme park pool that Pi Bani mentioned. It's soemwhere near Ampang off the ring road. Some months later a pool attendant, a Sabahan I think, died from the suction.

I shuddered when I read the news some months later...

Good of you to bring this up and warn others of the dangers!

Hello JT, its really sad about the two girls. I can imagine what the mother's going true.
We too here have read of such pool accidents or mishaps.
Always sad to read about young kids like this. My heart goes out to the parents and prayers to the kids.
